How to request Compensatory Benefits for subsidies after being on sick leave?

You can request Compensatory Benefits from Social Security if you have been on sick leave for more than 30 days in 2024, for vacation and/or Christmas subsidies.

"They are cash values that are paid to compensate for Christmas, vacation or other similar subsidies that the worker did not receive, in whole or in part, from the employer, for being unable to work due to illness or subsidized parenthood, for a period equal to or greater than 30 consecutive days," reads in a practical guide from Social Security. To be entitled to Compensation Benefits, it is necessary to be:

  • Employee worker;
  • Manager or administrator of legal persons (MOE'S), if the right to the respective subsidies is proven and the remaining working conditions are met.

And to submit the request, you have to access Social Security Direct - Employment - ‘Compensatory benefits for holiday and Christmas subsidies'.

From that point on, your request is registered and later analyzed by the Social Security services.  

Note that you have to request the compensatory benefits within six months from: 

  • 1st of January of the year following the one in which holiday and Christmas bonuses were due from the employer.
  • End date of the employment contract if there has been a termination of the contract.
